Terms and Conditions

Deposit and Payment

 The prices above are determined based on hours of coverage and number of shots taken. Each combination specified above designates a "Package Price". A combination must be specified at the signing of this contract; however, you may ask the photographer to stay longer (in one hour increments) if necessary, and the price will increase based on the list above.  If an additional number of shots are required to cover the events that take place in the time frame specified, you will be billed accordingly for those extra number of shots.  These additional charges will be due in addition to earlier price following the event date.  If this amount is not paid within 30 days, the client will be in default hereunder and shall pay 18% interest on the unpaid balance until payment is made in full.

 A non-refundable deposit is required to retain the photographer to perform the services specified herein.  This deposit will be applied to reduce the Total cost of services ordered herein.  The remaining balance will be due no less than 7 days prior to the event date.

Cancellation

 If this contract is cancelled at any time before the event date, any deposit paid to the photographer will not be refunded and client is required to notify us at once.  Exception: at least 2 month's advance notice.

Format

All photographs will be a 35mm or equivalent digital quality format unless otherwise specified.  Each recording media may contain at least as 20 to many as 1000 shots.  The size media used is based upon the photographer's discretion for the type of event covered.

Unable to perform

If the photographer cannot perform this agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, then the photographer shall return the deposit to the client, but shall have no further liability with respect to the agreement.  This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in shipping, or otherwise lost or damaged without fault on the part of the photographer.  In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client's order.

Inherent Qualities

Client is aware that the color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and the client releases the photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

Arbitration

If all photographs and recording media are accepted at the time of presentation there will be no dispute for any sum later on.  In this case, the client waves all rights to dispute any disagreements between client and photographer.  If the client is not satisfied with the photographs at the day of receiving them and refuses to accept them, he may ask for a full refund of the balance due only, except for any materials and the initial deposit is awarded to the photographer.

Conditions

The conditions of a photo shoot and their unpredictable nature do not guarantee an absolute account for every image requested.  A full day rate, incorporates eight (8) hours, whether the full time is used or not, the same will occur with 1/2  day rates which incorporate four (4) hours.  Overtime will be charged accordingly.

Usage

Gibson's Photo & Video is authorized to use images from this event for the sole purpose of promotion through print media, website promotion, or any other means of advertising. Gibson's Photo & Video is not authorized to sell these images in any means without the clients' consent.

Travel:         Up to 50 miles - $25.00.  Over 50 miles: $12.50/25 miles.
